Federal Service Animal Laws

The ADA, or Americans with Disabilities Act, governs the use of service dogs and service animals federally, when mainly public access rights are concerned.

There are additional, separate laws for when service dogs are in housing and air travel situations.

This article will go through each U.S. state and summarize that particular state’s service animal in training laws.

While the ADA does not cover service animals in training, certain states do. Of course, this can be confusing. Hopefully this article will help ease some of the confusion.

Service animals-in-training are not considered service animals under the ADA. Under the ADA, the dog must already be trained before it can be taken into public places. However, some State or local laws cover animals that are still in training.

  • Service dogs in training must be on a leash and must wear a county-issued tag that identifies the animal as a service animal or assistance animal in training

  • Louisiana state defines “Service dog” as a dog that has been trained or is being trained to do work or perform a task for a person with a disability.

  • Maine state law (§1312) provides those same rights of access for individuals who are “especially trained service dog trainers.” As defined in the Maine statute, an “especially trained service dog trainer, while engaged in the actual training process and activities of service dogs, has the same rights, privileges and responsibilities described in this section with respect to access to and use of public facilities as are applicable to a blind, visually handicapped or otherwise physically or mentally disabled person.”

  • Service animals in training have the same rights in New Mexico as fully trained service dogs or service animals. “Unlike the ADA and ADAAA, New Mexico’s Service Animal Act also prohibits a person from misrepresenting an animal as a service animal and provides penalties, including a fine and/or jail time. Additionally, in New Mexico, service animals in training are allowed the same access as a fully trained service animal.   • Service animals in training are covered in North Dakota as long as they are with a service dog trainer from a nationally recognized service animal training program.

25-13-02.1. Trainer and a service animal in training – Admission to public places.

  1. “A trainer with a service animal in training may enter any place of public
    accommodation, common carrier, facility of a health care provider, and any place to
    which the public is generally invited, without being required to pay an extra charge for
    the service animal in training, provided:
    a. The trainer notifies an onsite manager that a service animal in training is being
    brought onto the premises;
    b. The trainer wears a photo identification card issued by a nationally recognized
    service animal training program; and
    c. The trainer is liable for any damage done to the premises or facility by the service
    animal in training.
  2. Upon receiving notice as provided in subsection 1, the onsite manager may not deny
    admission to the trainer and the service animal in training without good cause.” – North Dakota Century Code

  • “Individuals using guide, signal or service dogs and trainers from recognized training centers with dogs in training may not be denied admittance to or refused access to public places.”
  • “These include, but are not limited to, streets, sidewalks, transportation vehicles, places of lodging, government buildings, college dorms, educational facilities, restaurants, stores, entertainment and recreation facilities or other places where the public is invited.”
